IS IT ALSO A CRIME?
Part 2

Following on from the April 2017 seminar, which covered discrimination on the grounds of criminal record, provisions of the Spent Convictions Act 2009 (SA) and reporting workplace conduct to police, this seminar will cover
 

  1. The rights of an accused – arrest rights, right to silence and protection against self-incrimination, presumption of innocence (recap and further detail).
  2. Evidence – admissibility of out of court statements and admissions (such as disciplinary interview records). Summons to appear to give evidence or to produce documents.
  3. Guilty pleas and defended matters. Timelines, procedures and penalties.
  4. Jurisdiction and onus of proof - civil and criminal proceedings.
  5. In relation to employees – options when criminal conduct is alleged but no report to Police has been made by the employer or alleged victim.
  6. In relation to employers – civil vs criminal proceedings as avenues for remedy.

Biography:     
After working for many years as an industrial advocate, Kaz commenced legal practice in 2002, specialising in employment related law.  After 8 years with Bourne Lawyers in Adelaide she moved to Port Pirie and added criminal law to her practice with Boylan Lawyers. She went to the independent bar in November 2013.  She works both in Adelaide and in the northern regional courts, accepting briefs mainly in criminal and employment law. She is recommended in Doyles Guide to leading Employment and WHS barristers.
